How does it work?

When homeowners experience home construction defects, the State of Texas has outlined a procedure and timeline that attorneys (and their clients) have to follow before filing a lawsuit against a General Contractor. Why? To give both sides the opportunity to present the issue and do their best to reach a reasonable settlement. If a settlement can’t be reached, then it may escalate to litigation.

In Texas, the Residential Construction Liabilities Act (RCLA) controls what and how attorneys have to navigate their clients’ situation, and is a complex statuatory law.

How long does the RCLA process take?

At a minimum, it takes a few months, but if can easily escalate to much longer depending on a number of factors.
